Terms and Conditions Agreement

This Terms and Conditions Agreement ("Agreement") governs your access to and use of the services provided by Samzal. By registering, browsing, listing, buying, selling, or using any part of this platform, you agree to be legally bound by the provisions of this Agreement. If you do not agree with any part of these terms, you must immediately discontinue use of the Platform.

1. Nature of Samzal’s Role

Samzal is an independent digital marketplace that connects buyers and sellers of digital assets such as social media accounts, gaming accounts, AI assets, SaaS properties, usernames, and related services. Samzal does not own, control, verify ownership, or guarantee the authenticity of any asset listed by users. Samzal acts solely as a neutral intermediary that provides escrow protection, dispute handling, and optional middleman services to reduce transaction risks.

2. User Eligibility and Responsibilities

• You must be at least 18 years old to use Samzal.
• You are fully responsible for the assets you list, buy, or sell.
• You must not list stolen, hacked, recalled, or illegal digital goods.
• You must not attempt to bypass Samzal’s escrow or protection systems.
• You must provide truthful and accurate information during disputes or verification.

3. Escrow Protection

Samzal provides escrow services where buyer funds are securely held until both parties confirm completion of the transaction terms. This service is provided for safety and dispute management. All escrow service fees are non-refundable.

4. Ownership Verification and Due Diligence

Samzal does not verify ownership of every listed asset. Buyers must conduct their own due diligence before purchasing any digital property. Samzal is not responsible for losses arising from poor buyer verification.

5. Dispute Resolution Process

In the event of a dispute, Samzal will review all evidence submitted by both parties. Users must cooperate fully. Decisions made by Samzal after investigation are considered final and binding.

6. Fees, Payments, and Chargebacks

Users are responsible for all payment gateway charges, crypto network fees, and third-party processing costs. Samzal is not responsible for chargebacks, reversals, or disputes between users.

7. Prohibited Conduct

• Fake listings or misrepresentation
• Fraud, scams, or payment abuse
• Harassment or abusive behavior
• Selling assets that violate original platform policies
• Attempting to bypass escrow or middleman systems

8. Personal Middleman & Trade Handling Disclaimer

8.1 Recalled or Recovered Accounts

If a digital asset is later recovered, hacked, reclaimed, or recalled by a previous owner after transaction completion, Samzal is not responsible and cannot assist in recovery.

8.2 No Chargeback Protection in Direct Payments

When buyers pay sellers directly in Personal Middleman deals, Samzal is not involved in payment processing and does not protect sellers from chargebacks or disputes.

8.3 Middleman Access Risk

Temporary access to accounts may be required to secure trades. Sellers acknowledge and accept this risk. Samzal is not liable for any restrictions or bans during or after this access.

8.4 Account Suspension During Handling

If an account is banned during middleman handling, recovery is solely the seller’s responsibility. No compensation will be provided.

8.5 Misconduct During Middleman Process

If proven misconduct occurs while under middleman control, Samzal may refund the middleman fee and provide limited compensation up to $100 USD.

8.6 Cancellation Policy

If canceled before transfer, a full refund is issued. After transfer, a $9.95 handling fee applies.

8.7 Third-Party Payment Systems

All payments are processed via third-party providers. Samzal is not liable for disputes arising from these systems.

8.8 72-Hour Dispute Window

After 72 hours from transaction completion, Samzal holds no liability for bans, recalls, or restrictions.

9. Limitation of Liability

All services are provided on an “as-is” basis. Samzal is not liable for bans, suspensions, performance loss, or any damage after transaction completion.

10. Indemnification

You agree to indemnify and hold Samzal harmless from any claims, damages, or legal costs arising from your misuse of the platform.

11. Intellectual Property

All website content, branding, design, and systems belong exclusively to Samzal.

12. Account Suspension and Termination

Samzal may suspend or permanently ban users who violate these terms without prior notice.

13. Governing Law

These terms are governed by the applicable laws of the jurisdiction where Samzal operates.

14. Entire Agreement

This document represents the complete agreement between users and Samzal regarding platform usage.
