DMCA Notice & Takedown Policy

Samzal respects the intellectual property rights of others and expects users of the platform to do the same. As a service provider under the Digital Millennium Copyright Act (DMCA), Samzal qualifies for safe harbor protections under 17 U.S.C. §512. This policy outlines the process for submitting copyright infringement claims and counter-notifications.

1. Reporting Copyright Infringement

If you believe that content hosted or listed on Samzal infringes your copyrighted work, you must submit a written DMCA Notice to our Designated Copyright Agent including the following:

  1. Your physical or electronic signature
  2. A description of the copyrighted work claimed to be infringed
  3. The exact URL or location of the allegedly infringing material on Samzal
  4. Your full name, address, telephone number, and email address
  5. A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner

2. Takedown Procedure

Upon receiving a valid DMCA Notice, Samzal will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the content
  • Allow the user to submit a counter-notification if applicable

3. Counter Notification

If you believe your content was removed due to mistake or misidentification, you may submit a Counter Notice containing:

  1. Your physical or electronic signature
  2. Identification of the removed content and its previous location
  3. A statement under penalty of perjury that removal was a mistake
  4. Your contact information
  5. A statement consenting to jurisdiction of appropriate courts

Upon receipt of a valid Counter Notice, Samzal may restore the material within 10–14 business days unless the original complainant files a court action.

4. Repeat Infringers

Samzal maintains a strict policy of terminating accounts of repeat copyright infringers where technically feasible.

5. Misuse of DMCA Process

Submitting false or misleading claims under the DMCA may result in legal liability under 17 U.S.C. §512(f).
